Columbia Steel Terms of Use

Columbia Steel Casting Co., Inc. (“Columbia Steel”) maintains this site (the “Site”) for your information, education, communication and personal enjoyment. Access to and use of this Site are subject to the terms and conditions set forth below, and your access to and use of this Site constitutes your agreement to be bound by, and to act in accordance with, all terms and conditions in these Terms of Use. If you do not agree to these Terms of Use, please do not use this Site.

1. Intended Users. By accessing, providing information on or through, or otherwise using the Site, you affirm that you are eighteen (18) years old or older, or that you are over the age of thirteen (13) and possess legal parental or guardian consent, and that you are competent and capable of understanding, agreeing to, and complying with these Terms of Use. Columbia Steel will never knowingly solicit or accept personally-identifiable information from children under the age of thirteen (13), or contact children under the age of thirteen (13) for marketing purposes.

2. Privacy Policy. Your use of the Site constitutes your agreement to our Privacy Policy, which is incorporated into and made a part of these Terms of Use.

3. No Unlawful or Prohibited Use. You warrant to Columbia Steel that you will not use the Site for any purpose that is unlawful or prohibited by these Terms of Use. You may not use the Site in any manner that could damage, disable, overburden, or impair the Site or servers or networks connected to the Site. You may not, through any means, obtain or attempt to obtain any materials or information not intentionally made available through the Site. You agree that your use of the Site will not violate the rights of any third party or breach any contract you have with or duty you owe to any third party.

Columbia Steel reserves the right, but has no obligation, to investigate your use of the Site to determine whether you have violated these Terms of Use or failed to comply with any applicable law, regulation, legal process, or government request.

4. Modification/Suspension/Discontinuance of the Site and/or Your Access. Columbia Steel reserves the right to modify, suspend, or discontinue the Site, any portion of the Site, any offering made available through the Site, and/or your access to the Site or any portion thereof at any time and without prior notice or liability to you. Columbia Steel will not be responsible or liable to you or any party for such modification, suspension, and or discontinuance. Accessing the Site after any suspension or discontinuance will constitute an act of trespass. If Columbia Steel suspends or discontinues your access to the Site or if you voluntarily discontinue use of the Site, these Terms of Use will continue to apply to all past use of the Site by you.

5. WARRANTY DISCLAIMER. The information, images, and other materials available through the Site may include inaccuracies or typographical errors. Columbia Steel makes no representations or warranties about the suitability, reliability, availability, timeliness, or accuracy of the information, images, and other materials contained on the Site for any purpose. To the maximum extent permitted by applicable law, all such information, images, and materials are provided “as is” and “as available” without warranty or condition of any kind. Unless otherwise explicitly provided in connection with Columbia Steel’s products and services, Columbia Steel hereby disclaims all warranties and conditions with regard to the information, images, and other materials offered through and/or contained on the Site, including all implied warranties or conditions of merchantability, fitness for a particular purpose, title, and noninfringement. Columbia Steel expressly disclaims any representation or warranty that the operation of the Site will meet the user’s requirements; that the Site will be free from viruses or other harmful components; that communications to or from the Site will be secure and not intercepted; that the capabilities offered on the Site will be uninterrupted; or that access to the Site will be free from errors or defects.

6. LIMITATION OF LIABILITY. Columbia Steel expressly disclaims any liability for any damage to or viruses that may infect your computer or other property due to your use of this Site or any site linked to or from this Site or your downloading of any materials, text or images from the Site or from any site linked to or from the Site. To the maximum extent permitted by applicable law, Columbia Steel shall not be liable for any direct, indirect, consequential, special, incidental or punitive damages arising out of your access to or use of this Site or any site linked to or from this Site, regardless of whether based on contract, tort, negligence, strict liability, or otherwise, and regardless of whether Columbia Steel has been advised of the possibility of such damages.

7. Limitations to Sections 5 and 6. Applicable law may not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain damages. Accordingly, some of the above limitations or exclusions in Sections 5 and 6 may not apply to you. However, in no event will Columbia Steel’s total liability to you for claims, damages, losses, liabilities, and costs and expenses, including without limitation reasonable attorneys’ fees and costs (whether in contract, tort, negligence, strict liability, or otherwise) exceed the amount paid by you to Columbia Steel, if any, solely for accessing or using the Site.

8. Indemnification. You agree to defend, indemnify, and hold harmless Columbia Steel and its officers, directors, employees, agents, successors, licensees, and assigns, for, from and against any and all claims, damages, losses, liabilities, and costs and expenses, including without limitation reasonable attorneys’ fees and costs, arising out of or relating to your breach of these Terms of Use, your violation of any law or right of any third party through your use of the Site, or your use or misuse of the Site or any information, images, or other materials made available through the Site.

9. Links to Third-Party Sites. For our customers’ convenience, Columbia Steel provides links to other sites. If you click on the links, you will leave this Site and be subject to the terms of use and privacy policies of the linked sites. In addition, links to this Site may be provided from other sites either known or unknown to Columbia Steel. Columbia Steel is not responsible for the content of any site that is linked to or from this Site. The fact that another site is linked to or from this Site does not imply that: (a) Columbia Steel sponsors, licenses, endorses, is affiliated with or is otherwise connected to the linked site, the products or services described therein or its owner; or (b) Columbia Steel has authorized the linked site to use any trademark, trade name, logo, copyrighted material, or other material or information of Columbia Steel.

10. Contributions. By submitting ideas, suggestions, documents, and/or proposals (“Contributions”) to Columbia Steel through the Site, you acknowledge and agree that: (a) your Contributions do not contain the confidential or proprietary information of you or any third party; (b) Columbia Steel is not under any obligation of confidentiality, express or implied, with respect to the Contributions; (c) Columbia Steel shall be entitled to use or disclose (or choose not to use or disclose) such Contributions for any purpose, in any manner and in any media; (d) Columbia Steel may have something similar to the Contributions already under consideration or development; (e) your Contributions automatically become the property of Columbia Steel; and (f) you are not entitled to any compensation of any kind from Columbia Steel for your Contributions.

11. Ownership of Site Materials. This Site, its contents and structure are the sole and exclusive property of Columbia Steel or its licensors, and Columbia Steel and its licensors retain all right, title, and interest (including all copyright, trademark, and other proprietary rights) in the Site. All texts, images, graphs, audio, video, animation files, and other content must not be copied, republished, displayed, transmitted, sold, offered for sale, or otherwise distributed or used without Columbia Steel’s prior written consent. Unless otherwise expressly allowed in a specific portion of the Site, you may not amend, translate into any other language, create derivative works based on, reverse engineer, or frame any material on or comprising this Site.

12. Trademarks. The brands, trademarks and logos used in this Site are registered or otherwise protected and include: Armor Block®, Columbac®, Columbia®, CSC stylized mark®, Columbia Engineering Works®, Columbia Steel®, C stylized mark®, Drop Cross®, TwistLink®, Xtend Process®, Xtralloy stylized mark®, XtraLife®, Dogbone®, EZ Drive™, and EZ Ring™. The foregoing brands, trademarks, and logos (as well as other brands, trademarks, and logos used on the Site) are registered or unregistered trademarks of Columbia Steel Casting Co., Inc. in the United States and other countries. Unauthorized use of such brands, trademarks, and logos is strictly prohibited.

All brand names, model names or marks of third parties are owned by their respective owners and are included on the Site for reference purposes only. Columbia Steel has no affiliation with the Original Equipment Manufacturers (OEM) referenced on the Site. These OEM names are provided for identification purposes only and are not intended to indicate affiliation with or approval by Columbia Steel of the OEMs, or to indicate affiliation with or approval by the OEMs of Columbia Steel. All parts referenced on the Site are manufactured by Columbia Steel and are not manufactured by, purchased from or warranted by any OEM referenced in connection with such parts.

13. Columbia Steel Blog and Copyright Infringement Policy. Columbia Steel offers Point of View (P.O.V.) The Columbia Steel News Blog (the “Blog”), located https://columbiasteel.com/category/news/, for your information, enjoyment, and comment. Your use of the Blog is subject to these Terms of Use and constitutes your agreement to these Terms of Use, as well as the Blog Terms of Service, located at https://columbiasteel.com/blog-terms-of-service/, which Terms of Service are incorporated into and made a part of these Terms of Use.

Columbia Steel will disable access to or remove any content posted on the Blog that it believes in good faith is infringing a copyrighted work. If you believe that your copyright has been infringed by content posted on the Blog, please refer to the Columbia Steel Copyright Infringement Policy at https://columbiasteel.com/copyright-infringement-policy/ for information regarding how to file a notice of infringement. This Copyright Infringement Policy is incorporated into and made a part of these Terms of Use, and your use of the Blog constitutes your agreement to the Copyright Infringement Policy.

14. Modification of Terms of Use. Columbia Steel may, from time to time, revise and modify these Site Terms of Use. We will post any new Terms of Use here, and we encourage you to visit this area frequently to stay informed. If changes are significant, Columbia Steel will also notify you of such changes to these Terms of Use via the contact information you have provided to Columbia Steel, if any. Changes to these Terms of Use will apply immediately after the date on which we post the revised Terms of Use to the Site. 15. Severability. The provisions of these Terms of Use are independent of each other, and the invalidity or unenforceability of any provision of these Terms of Use shall not affect the validity or enforceability of any other provision, and such invalid or unenforceable provision shall be deemed to be removed from these Terms of Use.

These Terms of Use are governed by the laws of the State of Oregon, U.S.A., and you hereby consent to the exclusive jurisdiction and venue of courts, both federal and state, in Multnomah County, Oregon, U.S.A. in all disputes arising out of or relating to these Terms of Use or your use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms of Use. You agree that no joint venture, partnership, employment, or agency relationship exists between you and Columbia Steel as a result of these Terms of Use or your use of the Site.
